Canadian Wills
In Canada there are only two major types of wills which are attested wills and a holograph will. While both types work in the same manner that you would expect of a will there are a couple of significant differences between the two types of wills that you should know.
The holograph type of wills is a very basic type of will that is hand written by the individual. Using the holograph will is tempting for many people as you only need to sign and date the document and do not require any witnesses but there are a number of reasons that you should avoid wills of this type. While they are legally binding if you are unsure of what you are doing or leave out important legal information that is crucial for wills in Canada it may be determined that the will is invalid and they can also be contested much easier than attested wills which are professionally prepared.
The other major type of wills in Canada is the attested will which by far the most common type as it is more secure and allows for greater peace of mind. If you choose to use an attested will the easiest and most cost efficient method of ensuring that the wills are filled out properly is by hiring a lawyer who has experience completing wills to prepare the document for you as this will ensure that you have covered all of your bases and that your wishes will be carried out to the letter once you have passed on.
