Ontario Separation Agreement
A separation agreement is much different than a marriage contract although both of these are legal documents. When you and your spouse are filling out a separation agreement you are choosing the rights of each party. Like a marriage contract this can include things like debt repayment, who gets what, but a separation agreement can also dictate who will live in the matrimonial home, support payments, and child custody.
The Government of Ontario has established that no employee will work more than 48 hours per seven day week and that after 44 hours of work that employee must be paid overtime. Overtime pay is set at the bare minimum of one and a half times the employees regular hourly wage however some companies will pay their employees more than this.
Many Canadians do not realize that they can in fact prepare their own legal separation agreement but doing so is generally not recommended. In an ideal situation each of the spouses would have their own lawyer working on the separation agreement to ensure that the rights of both parties are being looked after.
