Police Search Canada
Despite popular Canadian belief there are only five reasons that the police may search your person. The five reasons that an officer can perform a police search include if you agree to the search, when you are arrested, if the police believe you are committing or have recently committed a weapons related crime, they find alcohol or drugs in your vehicle, and the last reason that an officer may perform a police search is if they are searching for drugs and you are in the location and they suspect you may have drugs on your person. No matter the reason an officer chooses to search you , you have the right to speak with a lawyer and you are not required by law to answer any of their questions.
An officer can also perform a police search on your home in a couple of different situations. The first reason that a police officer may enter and search your home is if you agree to the search and allow them to enter. The last reason that an officer may perform a police search inside your home is if they have a warrant to search your home or to arrest you. There are also a number of emergency situations in which the police may enter your home but they are not allowed to search during these visits. If you are having difficulty with the police or would like further information you should speak to a lawyer. You can find a local lawyer in our free legal directory located here.
